Amnesia Digital provides digital privacy services, including:

• Free Digital Footprint Scan: A complimentary scan that identifies publicly accessible information associated with the email address or name you provide. This scan is provided as a lead-capture service and its results are illustrative.
• Digital Footprint Report ($29 one-time): A detailed report identifying the data broker sites, people-search databases, and other online sources where your personal information appears.
• Content Removal Service ($149 one-time): Our team submits removal requests on your behalf to data brokers, people-search sites, and other online directories to have your personal information removed or suppressed.

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice. Prices are subject to change; any changes will be communicated in advance and will not affect completed purchases.

You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Our Services are intended for personal use — helping individuals manage their own digital footprint. You agree not to use our Services to remove information about other individuals without their explicit written consent.

Certain features of our Services may require you to provide an email address and other information. You agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activities that occur under your account.

You agree to notify us immediately at amnesia@nanocorp.app of any unauthorized use of your account or any other security breach.

You understand and acknowledge the following limitations of our Services:

• The accuracy and completeness of the Free Scan and Digital Footprint Report depend on publicly available data and the capabilities of our scanning technology. Results may not capture every instance of your information online.
• Data brokers and third-party websites are under no legal obligation to honor removal requests in all jurisdictions. The Content Removal Service represents our best-effort submission of opt-out requests; we cannot control whether third parties comply.
• Even after successful removal, your information may reappear on data broker sites as they periodically re-aggregate data. Our one-time service does not include ongoing monitoring or re-removal.
• Certain types of information (e.g., court records, government databases, news articles) cannot be removed through our service.

You agree not to use our Services to:

• Remove information about individuals other than yourself without their explicit consent
• Engage in any unlawful activity, including attempting to evade legal processes or remove information subject to legal holds
• Circumvent, disable, or otherwise interfere with security-related features of our website
• Use automated tools, bots, or scrapers on our website without our written consent
• Impersonate another person or entity
• Upload or transmit viruses, malware, or any malicious code
• Violate any applicable local, national, or international law or regulation

We reserve the right to terminate or suspend access to our Services immediately, without prior notice, for any violation of these Terms.

All content, features, and functionality on amnesiadigital.co — including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof — are the exclusive property of Amnesia Digital and are protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our website and Services for your personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Services without our prior written consent.

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) RESULTS OBTAINED FROM USING THE SERVICES WILL BE ACCURATE, RELIABLE, OR COMPLETE; OR (C) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMNESIA DIGITAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business
• Loss of data or damage to data
• Loss of goodwill or reputation
• Cost of substitute services
• Any harm resulting from unauthorized access to or alteration of your transmissions or data

ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TO AMNESIA DIGITAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the limitation of liability for consequential or incidental damages, so the above limitation may not apply in full.

You agree to defend, indemnify, and hold harmless Amnesia Digital and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Services; (c) your submission of false or misleading information; or (d) your violation of any applicable law or the rights of any third party.

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Links are provided for convenience only and do not constitute an endorsement.

Payment processing is provided by Stripe, Inc. Your use of Stripe's services is governed by Stripe's terms and conditions.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if the claims qualify.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Amnesia Digital each waive any right to a jury trial.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date and, where appropriate, notifying you by email. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using our Services.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amnesia Digital regarding the Services and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
